保国旗下讲话--护地球母亲 净化育英校园蒋阳林各位同学：早上好！今天是3月12日，新世纪的第一个植树节。所以今天我讲话的题目是《保护地球母亲，净化育英校园》。同学们，二十一世纪已翩翩降临人间。然而，挑战与机遇同在，困惑伴希望孪生，二十一世纪，也是人类面临挑战的时期。特别是人与自然关系极度紧张。人类过度砍伐森林，盲目开发耕种，大肆破坏植被，造成水土流失，土地沙化；任意挖掘自然资源，使地下矿藏日趋耗尽；废水、废物、废气源源不断排放，使自然环境严重恶化。人类向自然界过度的索取，遭致了大自然无情的报复：飓风、暴雨、暴风雪、洪涝、干旱、虫害、酷暑、森林大火、地震等灾情不期而至，频频地袭击五大洲。1998年，全世界因干旱等原因而造成的迁移性难民首次超过了战乱流民人数，达到了2500万人；预计到2025年，这样的难民将达到1亿人。干旱过后就是洪涝，我们永远不会忘记，1998年发生在我国长江、松花江等百年不遇的洪涝灾害，这次全国性的洪涝灾害，直接经济损失达250多亿美元。据统计，1999年全世界至少有7万人在超过700起的灾难中丧生。

比如刚才我们讨论的很多海关法的一些争议和问题，例如研究走私罪的罪和非罪、此罪和彼罪、关于犯罪形态的问题。刑法学是有范畴的，就是犯罪的构成要件和犯罪构成要件的特殊形态。用这个去研究它，它就会得出一个相对确定的结论。民法学也是一样。但是在海关法里我们看不到有一个关于海关法的构成要件的学说。我们在海关法的讨论当中，大家都会从自我的实践中主观地提出一些建议。但是由于我们没有这种范畴和知识体系，没有用这种要件的方法或者原理的方法来指导我们，所以我们得出来的结论都是不确定的，这样得出的东西就会导致“公说公有理婆说婆有理”，他就不是一个科学的方法。这个层面是我们很欠缺的。我一直有一个愿望，要写一个没有一个海关法条文的海关法著作。如果能够写出这种著作，那就真的代表我们变得科学了，否则我们现在的海关法研究就没有突破科学这张纸，它就依然是很幼稚的。
