公会挂靠经纪合同
一、协议目的、背景 1.1 甲方是一家从事直播新媒体综合服务公司，与多家网络视频媒体、直播平台拥有长期的战略合作关系，以在线直播为基础，构建造星生态圈，跨越泛娱乐产业；1.2 乙方是一家从事影视传媒、艺人经纪的影视文化公司，有能力招募、培养、发掘、包装具有一定潜力的人员成为乙方公司旗下艺人；1.3 协议目的：甲乙双方希望达成良好的合作关系，由乙方指派艺人在甲方指定的直播平台 （即甲方战略合作方，简称甲方指定平台）上担任“主播”获取相应的收益并进行分配，以达到双方共赢共收益的目的。二、合作期限2.1 本协议的合作期限为： 2017 年 9 月 8 日至 2018 年 9 月 7 日止； 2.2 本协议期满，除非甲乙任一方提前向对方发出不再续约的书面通知，否则本协议自动延续【一】年，依此类推。 三、甲方之权利义务 3.1 合作期间，甲方应保障与甲方指定平台的友好合作关系；3.2 甲方有权根据来自于其他方面反馈的最终用户意见，对艺人的才艺演绎情况提出修正意见，并同时有权严格约束乙方艺人的才艺演绎行为，乙方应予以协助；3.3 如果乙方艺人提供的才艺演绎引起最终用户投诉，或致使甲方的其他合作者受到行政或刑事处分的，甲方有权单方终止本协议而概不承担任何的违约责任，如甲方因此受到经济处罚，乙方应承担赔偿责任；3.4 甲方有权自主组织、协调和安排乙方艺人参与到甲方指定平台担任主播，如果乙方指派艺人不能根据甲方前述要求进行配合，乙方应提前不少于三（3）个工作日告知甲方，并更换其他艺人予以配合；3.5 甲方对乙方艺人的才艺演绎成果、肖像、姓名，拥有完全独立的使用权。乙方应保证甲方有权对前述才艺演绎成果或肖像以录像、照片等方式进行传播或修改、转许可等方式独立使用，而无须另行获得乙方、乙方艺人的许可。

艺人独家经纪合同
鉴于:1、甲方系依法设立、专门从事演艺经纪及相关文化传播的有限责任公司。2、乙方系艺人，乙方基于在演艺界发展的需要，对甲方的专业，权威经纪资源和对乙方的认可，愿意按照本合同委托甲方管理、经纪其演艺事业。3、本合同是依照《民法典》的规定构成甲乙双方之间的演艺经纪合同关系，不构成《劳动法》上的劳动合同关系。为了更有效地保证乙方在演艺界的发展，维护双方的合同权益，经甲乙双方友好磋商，并达成共识。为明确双方权利和义务关系，特签订本合同，以资双方共同遵守。第一条主要内容1、甲方在本合同有效期内为乙方从事演艺事业的独家及唯一经纪方。负责全权处理和管理本合同约定范围的乙方演艺活动及利益，并代表乙方与有关方签署及履行演艺活动的协议。2、乙方在本合同有效期内为甲方独家提供演艺服务。未经甲方书面同意，乙方不得与任何第三方签订、履行与本合同内容相同或近似的协议，不得自行联系或接受任何第三方推荐、提供、邀请的商业或非商业活动。
北京市房地产经纪合同

第四条 本合同履行期间，除甲方原因，乙方不能履行本合同第二条服务事项的，甲方不支付本合同第三条约定的各项服务费。乙方应将甲方已预付的服务费全部退还。乙方不能完全履行服务项目，则相应减少甲方应支付的服务费。具体数额甲、乙双方在补充条款中另行约定。本合同生效后，在合同履行期间甲方未经乙方同意，中途毁约，甲方已支付给乙方的服务费不予退还。未支付给乙方服务费，乙方有权按双方约定服务费的标准，向甲方追索。第五条 本合同履行期间，甲、乙任何一方需变更本合同的，要求变更一方应及时书面通知对方，征得对方同意后，双方在规定的时限内（书面通知发出＿天内）签订变更协议，否则，由此造成对方的经济损失，由责任方承担。第六条 本合同履行期间，乙方应定期将本合同第二条为甲方服务的各房地产经纪事项情况及时通告甲方，甲方对乙方的履约应提供必要的帮助。并有权随时进行查询、督促。乙方将本合同第二条为甲方服务的各房地产经纪事项转委托其他房地产经纪人的，必须事先征得甲方的书面同意，由此而增加的费用和法律责任，由乙方承担。第七条 甲、乙双方商定，乙方有下列情况之一的，甲方有权按本合同第十三条约定，追偿因乙方过失造成的经济损失：1.未经甲方书面同意，擅自改变为甲方服务的各房地产经纪事项内容、要求和标准的；2.未经甲方书面同意，转委托他人代理的；3.违反国家和本市有关法律、法规、违背诚实信用原则，或与他人恶意串通，损害当事人利益的；4. 。第八条 甲、乙双方商定，甲方有下列情况之一的，乙方有权按本合同第十三条约定，追偿因甲方过失所造成的经济损失：1.要求乙方服务的房地产经纪事项不明确，或提供的有关证件和资料不实；2.甲方利用乙方提供的信息、条件、机会，擅自不履行合同；3.违反本合同第三条及补充条款的约定，不按期给付或拒付服务费的；4. 。第九条 甲、乙双方商定，乙方履行本合同第二条各房地产经纪事项的服务，必须自本合同生效之日起至 年 月 日止。除甲乙双方另有约定同意延期外，逾期视作本合同自行终止。在本合同终止后的＿＿日内，如果委托人直接或间接地与经纪人最初物色的客户成交，那么经纪人有权获得经纪合同中订立的佣金。第十条 本合同履行期间，甲、乙双方因履行本合同而签署的补充协议及其它书面的文件，均为本合同不可分割的部分，具有同等法律效力。第十一条 本合同及补充条款中未约定的事项，应遵循我国有关法律、法规和本市规定执行。
